GENERAL CONDITIONS OF SALE (CGV)

ARTICLE 1 – GENERAL PROVISIONS AND SELLER IDENTIFICATION

These General Conditions of Sale (CGV) exclusively govern the contractual relationship between:

And any natural or legal person placing an order on the website (hereinafter "the Customer").

Placing an order on the site implies full and unreserved acceptance of these CGV by the Customer.

ARTICLE 2 – PRODUCTS AND ORDERS

2.1. Nature of Products The products offered are those displayed on the website on the day of consultation by the Customer, subject to stock availability.

2.2. Order Confirmation The purchase of an item implies immediate payment for the order. An acknowledgment email confirming the details of the order is automatically sent to the Customer once payment is validated.

ARTICLE 3 – PRICING AND PAYMENT TERMS

3.1. Pricing Prices for our products are stated in Euros (€), all taxes included (TTC), including the applicable French VAT (20%). Shipping and delivery fees are not included in the price displayed on the product page and are calculated during checkout prior to final payment.

The Seller reserves the right to modify prices at any time, but products will be billed based on the rates in effect at the time the order is placed.

3.2. Payment Payment for purchases is due immediately upon ordering via the secure payment gateways available on Shopify (Credit Cards, Apple Pay, etc.). The payment amount is debited immediately upon order validation.

ARTICLE 4 – DELIVERY AND SHIPPING

Products are delivered to the shipping address specified by the Customer during the checkout process.

• Delivery Zones: Metropolitan France, European Union, and International.

• Processing Times: Orders are processed and dispatched within 2 to 4 business days following payment validation.

• Delivery Issues: The Seller cannot be held responsible for delivery delays attributable to postal services/carriers (La Poste, Colissimo, Delivengo, etc.) or for incorrect address details entered by the Customer.

ARTICLE 5 – RIGHT OF WITHDRAWAL AND RETURNS (30 DAYS)

5.1. Extension of the Legal Deadline In accordance with the law, the statutory withdrawal period is 14 days. The Seller grants the Customer an extended period of thirty (30) days from the physical receipt of the products to exercise their right of withdrawal without having to justify any reason.

5.2. Legal Exceptions to the Right of Withdrawal In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to:

• Audio or video recordings (CDs, vinyl records) when their protective seal/packaging has been unsealed or opened by the Customer after delivery.

5.3. Return Procedure and Conditions

1. The Customer must notify their intent to return an item by email to: merch@bothsxdes.com.

2. Items must be returned in their original condition (unworn, unwashed, tagged, and in original packaging) to the following address:

3. Return Shipping Costs: Return shipping costs remain the exclusive responsibility of the Customer.

5.4. Refunds Upon receipt and inspection of the returned item, the Seller will process a refund for the amounts paid (product price and standard initial shipping fee) within a maximum of 14 days using the same payment method used for the original purchase.

ARTICLE 6 – LEGAL GUARANTEES

All products benefit from the legal guarantee of conformity (Articles L.217-3 and following of the French Consumer Code) and the legal guarantee against hidden defects (Articles 1641 and following of the French Civil Code). In the event of receiving a defective or non-compliant product, the Customer must contact the Seller within 48 hours of receipt at merch@bothsxdes.com with supporting photos to arrange for a replacement or refund at our expense.

ARTICLE 7 – PERSONAL DATA (GDPR)

Information collected during the order process is required to process the transaction and ship parcels. This data is handled confidentially via Shopify’s secure infrastructure and is never sold to third parties.

The Customer has the right to access, rectify, oppose, and delete their personal data by sending an email to merch@bothsxdes.com.

ARTICLE 8 – APPLICABLE LAW AND DISPUTE RESOLUTION

These CGV are governed by French Law.

In the event of a dispute, the Customer agrees to contact the Seller in priority by email (merch@bothsxdes.com) to seek an amicable solution. Failing an amicable agreement, consumer customers may use a free consumer mediation service or consult the European Online Dispute Resolution (ODR) platform.
